Experience: Applicants must possess qualifying post-licensure litigation or adjudication experience. Qualifying trial experience includes experience litigating cases in which a complaint was filed with a court or administrative agency, or a charging document (e.g., indictment, notice of violation, or information) was issued by a court, administrative entity, grand jury, or appropriate military authority. Qualifying experience conducting administrative hearings or adjudicating administrative cases includes relevant experience handling cases in which a formal procedure was initiated by a governmental administrative body.
NOTE: Qualifying experience is calculated only after bar admission.

Dear State of Maine Employees:

To help address concerns stemming from recent news coverage, DAFS and the Office of the Attorney General are offering guidance on procedures and protocols regarding requests to provide access to non-public spaces in public buildings, or requests to produce documents.

Occasionally, individuals show up at public buildings unannounced and request access into areas where they are not authorized, or request information that is confidential or otherwise protected. It is legal to be in public spaces, assuming proper badging/credentials, compliance with screening requirements, and any other statutes, rules or regulations in force. This Guidance will help prepare you if you receive requests to enter non-public areas or are asked to provide non-public information.

UNDERSTAND & PREPARE:

Not all areas of public buildings are open to the public. Certain areas contain confidential, private and non-public records, or are work areas not open to the public (for example: behind the service counter). For clarity, signage designating areas as “Authorized Personnel Only” has been distributed to agency contacts for posting. Unauthorized personnel are not allowed to enter these areas.

Even if areas are properly designated as non-public, there may be visibility into the spaces. Please ensure that confidential non-public records are not openly displayed and are stored in a manner that will not expose them to inadvertent public disclosure. Likewise, employee work areas that can be seen by the public should not contain personal items which they do not want the general public to observe.

HOW TO RESPOND TO REQUESTS TO ENTER NON-PUBLIC AREAS OR SEE NON-PUBLIC INFORMATION:

1) All areas should be clearly marked if they are not accessible to members of the public. Generally, visitors are allowed to be in public areas, so do not instruct them to leave the building.
2) Be polite and professional. Remain calm; speak slowly/quietly to avoid escalating and/or to de-escalate the interaction.
3) Be factual and truthful. If they ask for information that any other person would be entitled to receive, provide it in the same professional manner as you would for any other person.
4) Follow Attorney General Guidance for requests to access to non-public areas.
5) Follow Attorney General Guidance if documents or information are requested.
6) Do not ignore other customers who are there to receive services. If a customer is uncomfortable, ask the customer if you can take their phone number and call them back or assist them later.
7) Do not use a personal or State mobile device to film an individual. This can cause further escalation.
